The Zombie Risk: California & New York Post-Mortem Laws

Why failure to register with state secretaries can void your heirs' ability to sue.

The New Rules for After You’re Gone

New laws in California and New York (passed in 2025) protect your digital ghost. They stop people from making AI versions of you after you die. But there is a catch.

California: The Registry Rule

California bans unauthorized digital replicas of deceased stars. But to use this law, your heirs must register with the Secretary of State. If they don’t file the paperwork (Form NPSF-407), they can’t sue anyone.

New York: Specific Contracts

New York also protects digital replicas. But it requires very specific contracts. And just like California, registration is key to enforcement.

Nevada: The 6-Month Timer

In Nevada, if your heirs find someone using your likeness without permission, they only have 6 months to register a claim. If they miss that deadline, they might lose the right to sue forever.
